Distance Sales Agreement

1. Parties
This Distance Sales Agreement (“Agreement”) is concluded electronically between the parties whose details are provided below.

Buyer:
The natural or legal person who places an order through the website www.livancistore.com (“Buyer”).

2. Subject of the Agreement
This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of products ordered electronically by the Buyer through www.livancistore.com.

The Buyer declares that they have read, understood, and electronically approved all product descriptions, guides, and pre-information texts before placing an order.

3. Product Features and Natural Fabric Declaration
LIVANCI products are manufactured from 100% cotton yarns using traditional weaving techniques and natural fabrics produced on manual looms.

Due to this production character:

  • Minimal weaving transitions

  • Small variations arising from yarn density

  • ±1–2 cm measurement tolerance

  • Natural movement of cotton fabric

  • Natural form changes that may occur after contact with water

are inherent characteristics of the product and shall not be considered manufacturing defects.

The Buyer declares that they purchase the product with full knowledge and acceptance of its natural characteristics.

4. Order and Payment
By placing an order through the website, the Buyer electronically accepts this Agreement. Payment is made through the methods specified on the website.

The Agreement enters into force upon completion of the order and receipt of payment. The Seller shall issue the invoice in accordance with applicable legislation.

5. Delivery Conditions
Orders are dispatched within 5 (five) business days. Delivery times may vary depending on the operational processes of the shipping company.

In cases of force majeure such as natural disasters, war, strikes, or logistical obstacles, delivery periods may be extended. Once the product is delivered to the shipping company, the transportation process is subject to the carrier’s operational responsibility.

For international shipments, delivery times may vary depending on customs and logistics procedures of the destination country.

6. Right of Withdrawal
The Buyer may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery.

Withdrawal notice may be submitted:

Notification within the 14-day period is sufficient.

The right of withdrawal covers the right to try the product; it does not cover usage, washing, or alteration of the product’s form. Detailed conditions are further regulated in the Return & Withdrawal Policy.

7. Exceptions to the Right of Withdrawal
The right of withdrawal cannot be exercised in the following cases:

  • Products that have been used, washed, or altered

  • Products with damaged accessories

  • Products unsuitable for return due to hygiene reasons

  • Claims arising from natural fabric tolerances

  • Other exceptions specified in the Return & Withdrawal Policy

8. Defective / Faulty Products
If a genuine manufacturing defect (e.g., stitching error, visible damage) is identified, the Buyer may notify the Seller.

Natural weaving transitions, cotton-based form movements, or measurement tolerances are not considered defects. If a manufacturing defect is confirmed, the necessary resolution will be provided and related costs will be covered by the Seller.

9. Governing Law and Jurisdiction
This Agreement shall be governed by Turkish Law.

For Buyers residing in Türkiye, Consumer Arbitration Committees and Consumer Courts are authorized in case of disputes. The competent courts and enforcement offices are those of Istanbul.

For international sales, Turkish Law shall apply; however, mandatory consumer protection provisions of the Buyer’s country of residence remain reserved.

10. Entry into Force
By placing an order through the website, the Buyer declares that they have read, understood, and accepted this Agreement electronically.
